Terms of Service – KlikTransfer

These Terms of Service (“Terms”) apply to the use of the services provided by KlikTransfer, a service operated by Klikonline (“we”, “us”, “our”).
By using our website or services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Definitions

• User: any individual or legal entity using KlikTransfer.

• Service: the file transfer and storage services provided by KlikTransfer.

• Account: a personal environment granting the User access to the Service.

• Subscription: an agreement that allows a User to access paid features of KlikTransfer in exchange for a fee.

2. Applicability

These Terms apply to all use of KlikTransfer, including uploading, storing, sharing, and downloading files.
Any deviation from these Terms is only valid if agreed upon in writing.

3. Use of the Service

1. You are solely responsible for all activities conducted under your account.

2. You agree not to use the Service to:

   • upload, distribute, or share illegal, copyrighted, or offensive content;

   • transmit spam, malware, or any harmful software;

   • infringe upon the rights of others.

3. KlikTransfer reserves the right to suspend or terminate accounts or remove files in cases of misuse or violation of these Terms.

4. Subscriptions and Payments

1. KlikTransfer offers both free and paid subscription plans.

2. Payments must be made in advance using the available payment methods.

3. Subscriptions renew automatically unless canceled by the User via the client panel.

4. Refunds are not provided for paid periods, unless required by law.

5. Termination and Suspension

1. Users may cancel their subscription at any time through the client panel.

2. Upon termination, access to paid features will be revoked.

3. We reserve the right to suspend or terminate accounts for misuse, non-payment, or breach of these Terms.

4. Data from terminated accounts will be deleted after a reasonable period, in accordance with our Privacy Policy.

6. Intellectual Property

1. All rights to the software, design, and content of KlikTransfer are owned by Klik Online or its licensors.

2. By uploading files, the User retains all ownership rights but grants KlikTransfer a limited license to store and make the files available as intended through the Service.

7. Privacy and Data Protection

We process personal data in accordance with applicable privacy laws, including the General Data Protection Regulation (GDPR).

8. Liability

1. KlikTransfer shall not be held liable for any damages resulting from the use of the Service, except in cases of willful misconduct or gross negligence.

2. We do not guarantee that the Service will be uninterrupted or error-free.

3. The total liability of KlikTransfer is limited to the amount paid by the User during the three (3) months preceding the event giving rise to the claim.

9. Changes to the Terms

KlikTransfer reserves the right to modify these Terms at any time.
Changes will be announced at least 14 days in advance. Continued use of the Service after such notice constitutes acceptance of the updated Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed exclusively by Dutch law.
Any disputes arising from or related to these Terms will be submitted to the competent court in Rotterdam.
